1. Scope and Seller

These Terms of Service apply to all purchases made by consumers ("you") from Darkgus ("we", "us" or "our") through this online store and website (the "Services"). A consumer is any person who buys for purposes that are mainly outside their trade, business or profession.

Our store runs on the Shopify platform. However, all sales in the store are made directly between you and Darkgus.

All communication with us is handled by email at wolkenwabe@outlook.es.

2. Access and Customer Account

By using our Services, you confirm that you are at least 18 years old or the age of majority where you live. You can place an order by creating a customer account or by checking out as a guest. You must provide complete, accurate and up-to-date information, such as your email address and billing and shipping addresses.

You are responsible for keeping your login details secure. You may not transfer, sell or share your customer account with anyone else.

3. Product Information

We do our best to show our products as accurately as possible. Colors and appearance may vary slightly depending on your screen and device settings. The product description shown at the time of your order applies. This does not affect your legal rights.

4. Placing an Order

Products shown in our store are an invitation to place an order, not a binding offer.

You make a binding offer when you add products to your cart, enter the required information and complete checkout by clicking the final order button. Before placing your order, you can review and correct your information at any time.

After you place your order, we will send you an automatic email confirming that we received it. This email is not yet an acceptance of your order. The contract is formed when we accept your order by sending an order confirmation email or by shipping the products.

We store the details of your order and send them to you by email. The language of the contract is English.

We may decline an order for a valid reason, for example if a product is unavailable or if we reasonably suspect misuse or fraud.

You confirm that you are buying the products for your own personal or household use and not for resale.

5. Prices and Payment

All prices are shown in the currency displayed in our store at checkout. Applicable taxes and any shipping costs are shown before you place your order. Depending on your country, import duties or local taxes may apply.

The price shown at the time of your order applies and is listed in your order confirmation. We may change prices for future orders.

Payment is made using the payment methods offered at checkout. You confirm that your payment details are correct and complete and that you are authorized to use the chosen payment method.

Promotions and discounts may be subject to separate conditions, which will be shown with each promotion.

6. Shipping and Delivery

We ship to the address you provide at checkout. The estimated delivery time is shown during checkout. Unless otherwise agreed, we will deliver within 30 days of your order.

If there are delays caused by shipping carriers, customs or other circumstances outside our control, we will let you know by email as soon as possible.

The risk of loss or damage to the products passes to you only when the products are delivered to you or to a person you have named to receive them.

7. Returns and 30-Day Satisfaction Guarantee

You can return your order within 30 days of receiving it. Full details are in our Return & Refund Policy, which you can view on our website at any time.

8. Damaged or Defective Products

If you receive a damaged, defective or incorrect product, please contact us right away at wolkenwabe@outlook.es and include photos if possible. We will offer a replacement or a full refund. This is in addition to any rights you have under the consumer protection laws of your country, which are not affected by these Terms.

9. Limitation of Liability

To the extent permitted by law, we are not liable for any indirect, incidental or consequential damages arising from your use of the Services or the products, and our total liability for any claim relating to an order is limited to the amount you paid for that order.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded under applicable law. Your statutory consumer rights are not affected.

10. Intellectual Property

All content on our Services, including trademarks, text, images, graphics, videos, audio, and their design and arrangement, is protected by copyright or other rights and belongs to Darkgus or its respective owners.

You may use the Services only for your personal, non-commercial use. Without our prior written consent, you may not copy, distribute, modify, publish or otherwise use any content, except as permitted by law.

The Darkgus name and logo are trademarks of Darkgus. The Shopify name and logo are trademarks of Shopify. All other names and logos are trademarks of their respective owners.

11. Reviews and Feedback

If you send us reviews, suggestions or other content (together, "Feedback"), you grant us a non-exclusive, worldwide, royalty-free and unlimited right to use, copy and publish that Feedback to operate, improve and promote our Services.

You confirm that you own the rights to your Feedback, that it is truthful, and that you disclose any payment or benefit you received for a review. Your Feedback must not be unlawful, offensive, threatening, defamatory or otherwise objectionable, must not infringe anyone's rights, and must not contain malicious software. You may not use a false identity.

We may remove any Feedback that breaks these rules.

12. Prohibited Use

You may use the Services only for lawful purposes. In particular, you may not:
- use the Services in any unlawful or abusive way;
- infringe the rights of others, including intellectual property rights;
- provide false or misleading information, impersonate anyone, or send spam or phishing messages;
- upload or transmit malicious software;
- use robots, scrapers or other automated means to collect data in bulk, or get around security measures;
- do anything else that limits other people's use of the Services or could harm us or Shopify.

If you break these rules, we may suspend or delete your account and restrict your access to the Services.

13. Third-Party Links and Tools

Our Services may include links to third-party websites or tools. We have no control over their content and are not responsible for them. Please review their terms and privacy policies before using them. For complaints about third-party products or services, please contact the provider directly.

14. Errors

Despite our care, information in our store (such as prices, availability or product descriptions) may contain errors. We may correct obvious errors. If your order is affected, we will inform you by email right away, and you may cancel your order for a full refund. Your legal rights are not affected.

15. Privacy

Information about how we process your personal information is available in our Privacy Policy, which you can view on our website at any time.

16. Dispute Resolution

If you have a problem with your order, please contact us first at wolkenwabe@outlook.es. We will do our best to resolve it quickly and fairly. We do not take part in dispute resolution proceedings before a consumer arbitration board.

17. Changes to These Terms

We may change these Terms for future orders. The Terms in effect at the time of your order apply to that order. The current version is always available on this page.

18. Applicable Law and Final Provisions

Mandatory consumer protection laws of the country where you live remain unaffected by these Terms.

If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms will remain in effect, and the invalid part will be replaced by the applicable legal rule.

Headings are for convenience only and have no legal effect.
