1. Who We Are and Scope
Darkgus operates this online store and website (the "Services"). Our store runs on the Shopify platform. This Privacy Policy explains how we collect, use and share your personal information when you visit, use or shop on our Services, or when you communicate with us.
Darkgus is the controller of your personal information. All communication with us is handled by email at wolkenwabe@outlook.es.
Please read this Privacy Policy carefully. By using our Services, you acknowledge the processing of your information as described here.
2. Personal Information We Collect
Personal information is any information that relates to you or can be used to identify you. Depending on how you use our Services, we may process the following categories:
- Contact details: name, billing and shipping address, and email address.
- Payment information: payment method, transaction details and payment confirmations. Payments are processed by our payment providers; we do not store full card details.
- Account information: username, password, settings and preferences, if you create a customer account.
- Order information: products viewed, cart, wishlist, orders, returns and cancellations.
- Communications: the content of your messages to us, for example when you contact customer support.
- Device and connection information: information about your device, browser, network connection, IP address and other identifiers.
- Usage information: information about how and when you use and navigate our Services.
3. Where We Get Your Information
We receive your information:
- directly from you, for example when you place an order, create an account or contact us;
- automatically when you use the Services, especially through cookies and similar technologies;
- from service providers that process information on our behalf;
- from partners or other third parties.
4. How and Why We Use Your Information
We use your personal information to:
- provide our store, process orders and payments, ship products, handle returns and refunds, manage your account and provide customer support;
- comply with legal obligations, such as tax and accounting requirements, and respond to lawful requests from authorities;
- keep our Services secure, prevent fraud and misuse, improve our Services, and establish or defend legal claims;
- send you marketing emails, use non-essential cookies, and show you personalized advertising, where you have agreed to this or where the law otherwise allows it. You can opt out at any time (see Section 11).
If you are located in the European Economic Area or the United Kingdom, we rely on the following legal bases: performance of a contract, compliance with legal obligations, our legitimate interests, and your consent.
5. Cookies and Similar Technologies
We use cookies and similar technologies. Essential cookies (for example, for the cart, checkout and security) are needed for the store to work. Other cookies, especially for analytics and marketing, are only used in line with the choices you make in our cookie banner, where required by law. You can change or withdraw your choices at any time through the cookie settings in our store.
6. How We Share Your Information
We only share your personal information where necessary for the purposes described above or where you have agreed:
- with Shopify and other service providers acting on our behalf (for example IT services, payment processing, analytics, customer support, cloud storage, fulfillment and shipping);
- with shipping carriers and suppliers, as needed to deliver your order;
- with advertising and marketing partners, in line with your choices; these partners process information under their own privacy policies;
- with authorities, courts or other third parties where required by law or needed to establish or defend legal claims;
- in connection with a business transaction, such as a sale or merger, where permitted by law.
We do not sell your personal information for money. Some sharing with advertising partners for personalized ads may be considered "selling" or "sharing" under certain U.S. state laws. You can opt out of this at any time (see Section 11).
7. Our Relationship with Shopify
Our store is hosted by Shopify. Shopify processes information about your access to and use of the Services to provide and improve them. Your information may be transferred to Shopify and to third parties located in countries other than your own.
We also use enhanced Shopify features that draw on information from your interactions with our store, with other merchants and with Shopify. Where Shopify processes information for its own purposes, Shopify is responsible for that processing, including responding to your requests. For more information, see the Shopify Consumer Privacy Policy at https://www.shopify.com/legal/privacy and the Shopify Privacy Portal at https://privacy.shopify.com/en.
8. International Transfers
We and our service providers may process personal information in countries other than the one you live in, including the United States and Canada. Where required by law, we protect these transfers with recognized safeguards, such as Standard Contractual Clauses or an adequacy decision, including the EU-U.S. Data Privacy Framework and its UK extension where the recipient is certified.
9. How Long We Keep Your Information
We keep your information only for as long as needed for the purposes described in this policy. Order information is kept until your order is fully completed, and afterwards for as long as required by tax and accounting laws. Account information is kept until you delete your account. Information based on your consent is kept until you withdraw it. After that, your information is deleted or anonymized, unless we need to keep it to establish or defend legal claims.
10. Security
We take reasonable technical and organizational measures to protect your information. However, no security measure is perfect, and data sent over the internet may not be completely secure. We recommend that you do not send sensitive or confidential information to us through unsecured channels.
11. Your Rights and Choices
Depending on where you live, you may have the right to:
- access the personal information we hold about you;
- correct inaccurate information;
- delete your information, unless we must keep it by law;
- restrict or object to certain processing;
- receive your information in a portable format;
- withdraw your consent at any time, without affecting processing that took place before;
- opt out of targeted advertising and of the "sale" or "sharing" of your personal information.
You can unsubscribe from marketing emails at any time using the link in each email. We may still send you non-marketing messages, for example about your account or orders.
To exercise your rights, email us at wolkenwabe@outlook.es. We may ask you to verify your identity before responding. You may also use an authorized agent where the law allows it. We will respond within the time required by law, and we will never treat you differently for exercising your rights.
12. Complaints
If you have concerns about how we handle your personal information, please contact us first. You may also have the right to complain to your local data protection authority, for example the Information Commissioner's Office (ICO) in the United Kingdom or the supervisory authority in your EU country.
13. Third-Party Websites
Our Services may contain links to third-party websites or platforms. We are not responsible for their privacy practices, security, or the accuracy of their content. Please review their privacy policies. Information you post on public or semi-public platforms, such as social networks, may be visible to other users.
14. Children
Our Services are not directed at children. We do not knowingly collect personal information from anyone under 16 years of age. If you are a parent or guardian and believe your child has given us personal information, please email us at wolkenwabe@outlook.es so we can delete it.
15. Changes to This Privacy Policy
We may update this Privacy Policy from time to time, for example to reflect changes in our practices or for legal reasons. We will publish the current version on this website and update the "Last updated" date. Where required by law, we will also notify you.
16. Contact
For any questions about privacy or this Privacy Policy, or to exercise your rights, contact us by email at wolkenwabe@outlook.es. We will reply as quickly as possible.
